This is an interlocutory appeal from the district courts partial denial of defendants motion to suppress evidence. Defendant was charged with cultivation of a controlled substance, a third degree felony, and claims the police obtained their evidence from an illegal search of his mothers home. The police did not have a warrant, but were invited to search the home by defendants sister, whom they believed to have authority to consent to the search. Defendant claims his sister did not have authority to consent to the search, and that the police could not have reasonably believed that defendants sister had such authority. We reverse the trial courts denial of defendants motion to suppress.
